Exploring Gary's Journey
A Life of Dedication and Compassion

BYU Law School

President Oaks and his associates overcame all these hurdles and more to make BYU’s J. Reuben Clark Law School a precocious member of the top 25 in the latest U.S. News & World Report law school rankings. Most top law schools were founded in the 1800s, and, in fact, all but two of the report’s top 28 schools were founded before 1910 — UCLA in 1949 and BYU in 1973.

Living trusts often fail to avoid probate.

Laws may change every year,
so you end up with probate anyways

Those “one night stand” attorneys have convinced thousands of people that a Living Trust is “written in stone.”

But the reality is that just not true.

Laws can and do change often at the federal and state levels.

If your trust isn’t updated to account for these changes, you might end up in Probate court even though you have a living trust.

Your personal or family situation may change, making your
Living Trust
"out of date"

How many of us have the same concerns, worries, and priorities that we did when we were in college?

As time passes, our lives changes. Maybe you’ve been fortunate enough to add a grandchild or two (or five) to the family.

Maybe you or a loved one has been through the hardship of a divorce or death in the family.

As our lives changes your Living Trust needs to change with it.

Your assets may not have been properly added to the Living Trust (& assets acquired afterwards remain unprotected)

A Living Trust is like a bucket. If you don’t put your assets like your house, bank accounts, etc into the bucket, the Living Trust does not protect those assets.

Transferring assets into the Living Trust is extra work for that “one night stand attorney” so many of them simply don’t do it.

Don’t be fooled! Unless ALL of your assets have been properly transferred, that Living Trust of yours is a ticking time bomb.

That's why I created
The "Family Plans"

Avoiding Probate is just the tip of the iceberg.
A Family Plan protects you in ways a Plain-Old Living Trust could never do!

Here's all the ways a Family Plan can
protect you & your loved ones...

1.

Avoids Probate

Most of my clients over the last 20 years have been hard-working Americans who were totally unprepared for the legal complexities of Probate Court. In some states, Probate can cost up to 7% of the total value of your assets.
The Family Plan utilizes state-of-the-art planning strategies to make sure your assets, and more importantly, your family, won’t have to endure this archaic system after your death.

2.

Avoids The "Double Probate"

What the “one-night-stand” attorneys left out of their sales pitch is that even if your existing Living Trust is set up to avoid probate right now, it’s not going to always stay that way.
Your assets may not have been transferred properly into your trust at the time of creation.

It may be that new assets were acquired without being transferred into the trust, your trust documents will be subject to what I call the “Double Probate.”

This is a secret back door where Probate can sneak in and undo all the hard work you put into setting up your trust.

3.

Fixes your existing Living Trust or Will

Don’t worry, if you don’t already have a Living Trust our Family Plan will create a new one for you.

However, if you already have a Living Trust, we can upgrade it to the Family Plan, preserving your original intentions.

Only this time, your documents will work as you intend and stay up-to-date.

4.

Avoids the
"4 Dirty Secrets" of Living Trusts

Your first priority is probably avoiding Probate, but did you know there are a host of other legal predators out there that can attack your family and your money?

I call these the “4 Dirty Secrets” of Living Trusts.

Some of these, such as the Adult Guardianship/Conservatorship Court Abuse can rob you of your freedom, your dignity, and your money while you’re still alive.

A Plain-Old Living Trust doesn’t shield you from these threats.

A Family Plan does.
